Charnwood Industries Pty Ltd (ABN 87 690 793 358) is the single legal entity, and the data controller, behind every Charnwood product and service, including the Charnwood Systems consulting and software engineering practice. 'Charnwood Systems' is a registered business name of that company rather than a separate company. This is Charnwood Systems' own Privacy Notice, and it covers charnwoodsystems.io and its subdomains. It covers everything those surfaces do, with any service-specific detail set out as a labelled sub-section within this Notice rather than as a separate policy. Any other website this company operates publishes its own privacy notice covering what that website collects, and this Notice does not describe it. More than one notice does not mean more than one company: there is one company and one ABN behind all of them, and a request you make to us under this notice reaches that company whichever website you sent it from.

Do we send the details you type into a form to an advertising platform? On this website, yes, and this is the key point to read. Where advertising cookies are running, and outside the EEA, the UK and Switzerland they run unless and until you turn them off, the Meta (Facebook) pixel reads the name, email address and mobile number you enter into a form, converts each into a code (a 'hash') in your browser, and sends those codes to Meta in the United States, so Meta can match you against its own record of the same details. 1. What information do we collect?

Personal information you disclose to us

In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

Personal Information Provided by You. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include the following:

We do not collect payment card details. If we ever offer something you can pay for, payment is taken through a payment provider's own checkout, so your card details go to that provider and not to us.

Information automatically collected

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

The information we collect includes:

Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. In order to enhance our ability to provide relevant marketing, offers, and services to you and update our records, we may obtain information about you from other sources, such as public databases, joint marketing partners, affiliate programs, data providers, and from other third parties. This information includes mailing addresses, job titles, email addresses, phone numbers, intent data (or user behaviour data), Internet Protocol (IP) addresses, social media profiles, social media URLs, and custom profiles, for purposes of targeted advertising and event promotion.

In Short: Forms on this website collect personal information. They are enquiry, consultation and contact forms, and each takes the same details you enter so that we can respond to you.

Forms on this website collect personal information. They are enquiry, consultation and contact forms: any form here that invites you to get in touch takes the same details, and we handle them all the same way. What differs is only what you are asking us about. The form published today is:

  • Get in touch about a piece of work, or about anything else (charnwoodsystems.io/contact). First name, last name, company or organisation name (optional), mobile number, email address, and your message.

That form also records which page the enquiry came from, and that you acknowledged the collection notice shown beside the submit button. A submission may involve an advertising click identifier, described below. Any other form we publish here is handled the same way.

No form named above asks you for a postal address, a job title, a billing address or a payment card, and none accepts a file upload.

How we handle them. The processing is the same for each, so it is stated once here. We use the information you provide to respond to your enquiry, to send you a confirmation, and to assess a possible engagement. Each submission is delivered to us by email and is also recorded in our systems, where the details you entered are encrypted with a key unique to that submission, so that destroying that key permanently prevents the submission being read. We do not use these forms to create a standing marketing profile of you. What the advertising platforms on this website receive when you submit a form is a separate matter and is the most important thing in this notice: it is set out under 'What advertising platforms receive when you submit a form' below. We rely on your consent and our legitimate interest in responding to enquiries as the legal bases for this processing (see 'What legal bases do we rely on to process your personal information?' below).

Advertising measurement when you arrive from one of our advertisements. When you reach this website by clicking a Google advertisement, the link carries a click identifier generated by Google (sent as gclid, gbraid or wbraid). Our advertisements can point at any page here, including pages that carry no form, so we do two things to keep that identifier from being lost before you reach one. We carry it on the links from the page you landed on to the page you go to next; and, where advertising cookies are running for you, we also store it in a cookie on your device for up to 90 days, which is described under 'Which cookies do we set ourselves?' in our Cookie Notice: charnwoodsystems.io/cookie-policy. If you have declined advertising cookies, or you are somewhere we ask you first and you have not yet answered, nothing is stored on your device and only the link-carried identifier is used. If you then submit an enquiry through a form here, we record that identifier alongside your submission, encrypted in the same way and under the same key, and we may report to Google that the click resulted in an enquiry. What we send to Google is the click identifier, the time, an internal reference number for the submission, and your advertising cookie choice. We do not send Google your name, email address, mobile number, company name, or your message, in any form, including in a hashed or encoded form. That statement is about what our own systems report to Google. It is not true of the Meta pixel, which runs in your browser rather than on our servers and does send a hashed copy of what you entered; that is set out under 'What advertising platforms receive when you submit a form' below. Google is located outside Australia, so reporting the click identifier to Google is a disclosure of an identifier that relates to you to an overseas recipient, and we describe it here for that reason even though none of the details you typed are included. Your advertising cookie choice is sent with it and Google applies that choice; you can change it at any time through our cookie preferences, and you can decline advertising cookies before submitting the form. If you reach this website any other way, there is no click identifier, and nothing is recorded or reported.

What advertising platforms receive when you submit a form

In Short: On this website, the Meta (Facebook) pixel sends Meta a hashed copy of the name, email address and mobile number you enter into a form, so that Meta can match you against its own record of the same details. Meta is in the United States. Hashing is how that match is made and does not make the information anonymous. You can stop it at any time on our cookie preferences page.

What runs here, and why. The Google Ads tag, the Meta pixel and the LinkedIn Insight Tag run on this website, because Charnwood Systems is the business that advertises on those platforms and holds the accounts they report into. Every tag that runs here is listed, with what each is for, in our Cookie Notice: charnwoodsystems.io/cookie-policy.

What is sent, and by what. Meta's pixel is a small piece of code that runs in your browser on this website. Meta's automatic advanced matching is switched on, so when you submit any of the forms described above the pixel reads the values you typed into the name, email address and mobile number fields, converts each one into a fixed-length code (a 'hash') in your browser, and sends those codes to Meta together with the fact that a form was submitted and the page you were on. This happens in your browser, alongside your submission rather than as part of it: our own systems send Meta nothing.

Why we do it. Meta compares those codes against codes it holds for the same details in its own records. Where they match, Meta can report to us that an advertisement it showed led to an enquiry, and can build audiences of people like you for our advertisements to be shown to. This is a different purpose from responding to your enquiry, which is why it is disclosed to you here rather than left to be inferred from the fact that we advertise.

Hashing is a matching mechanism, not anonymisation. We say this plainly because it is easy to assume the opposite. A hash is not readable by a person and we cannot turn it back into your email address. It is not anonymous: the same email address always produces the same code, which is exactly why Meta can use it to recognise you, and Meta can recognise you only because it already holds the same details. Treat this as a disclosure of your name, email address and mobile number to Meta, because that is what it is capable of doing.

Meta is an overseas recipient. The recipient is Meta Platforms, Inc., which is located in the United States, so this is a cross-border disclosure of personal information under Australian Privacy Principle 8. Meta operates in other countries as well and may process the information outside the United States; the countries it uses are Meta's to state and are described in its own privacy policy at facebook.com/privacy/policy. Meta receives this information under its own terms for businesses and uses it for its own purposes as well as ours, so it is not a service provider acting only on our instructions, and you should read its privacy policy as well as this one to know what it does with what it receives.

Whether it happens at all depends on your cookie choice, and where you are decides the starting point. It happens only while advertising cookies are running for you. If you are in the European Economic Area, the United Kingdom or Switzerland, or we cannot tell where you are, nothing optional runs until you accept it, so this does not happen unless you have accepted. Everywhere else, including Australia, advertising cookies are treated as accepted unless and until you turn them off, so for most visitors to this website this is what happens by default. You can turn them off at any time on our cookie preferences page, and once you have, the pixel does not load and nothing is sent. Turning them off before you submit a form is what prevents the transfer for that submission. Under Australian privacy law we rely on this notice, on the purpose being one we have told you about, and on your ability to turn advertising off; where the GDPR applies to you we rely on your consent, which is why nothing runs in those regions until you give it.

2. How do we process your information?

In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We process the personal information for the following purposes listed below. We may also process your information for other purposes only with your prior explicit consent.

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

  • To deliver and facilitate delivery of services to the user. We may process your information to provide you with the requested service.
  • To respond to user enquiries and offer support to users. We may process your information to respond to your enquiries and solve any potential issues you might have with the requested service.

  • To set up and manage anything you pay us for. You cannot pay for anything through the Services today. If and when we offer a paid product or subscription, we may process your information to set it up, to take payment for it, and to deal with any cancellation or refund.

  • To determine the effectiveness of our marketing and promotional campaigns. We may process your information to better understand how to provide marketing and promotional campaigns that are most relevant to you.
  • To save or protect an individual's vital interest. We may process your information when necessary to save or protect an individual's vital interest, such as to prevent harm.

We process your personal information under Australia's Privacy Act 1988 (Cth) and the Australian Privacy Principles. Because we operate internationally, we may also rely on the following legal bases where the laws of other jurisdictions (such as the General Data Protection Regulation (GDPR) in the EU and the UK GDPR) apply to you:

  • Consent. We may process your information if you have given us permission (i.e. consent) to use your personal information for a specific purpose. You can withdraw your consent at any time. Learn more about withdrawing your consent.
  • Performance of a Contract. We may process your personal information when we believe it is necessary to fulfil our contractual obligations to you, including providing our Services or at your request prior to entering into a contract with you.
  • Legitimate Interests. We may process your information when we believe it is reasonably necessary to achieve our legitimate business interests and those interests do not outweigh your interests and fundamental rights and freedoms. 4. When and with whom do we share your personal information?

In Short: We may share information in specific situations described in this section and/or with the following third parties.

Vendors, Consultants, and Other Third-Party Service Providers. We may share your data with third-party vendors, service providers, contractors, or agents ('third parties') who perform services for us or on our behalf and require access to such information to do that work. We have contracts in place with our third parties, which are designed to help safeguard your personal information. This means that they cannot do anything with your personal information unless we have instructed them to do it. They will also not share your personal information with any organisation apart from us. They also commit to protect the data they hold on our behalf and to retain it for the period we instruct.

The advertising platforms are the exception to the paragraph above, and we say so rather than leave it implied. Google, Meta, LinkedIn and X receive information through their own tags in your browser, under their own terms for businesses, and each uses what it receives for its own purposes as well as for ours. They are not acting only on our instructions, and we are not in a position to promise on their behalf that they are.

The third parties we may share personal information with are as follows:

  • Web and Mobile Analytics
    • Google Analytics, which measures visits to this website in a Google Analytics property held for Charnwood Systems. That property is linked to our Charnwood Systems advertising account with Google, so what it measures can also be used to build the audiences our advertisements are shown to. It receives none of the details you enter into a form
  • Advertising measurement
    • Google Ads, which receives the advertising click identifier described under 'Enquiry forms' above, and none of the details you enter into a form. Where advertising cookies are running, its tag on this website also sends it the page-view information described in our Cookie Notice
    • Meta (Facebook), which receives page-view information through its pixel on this website, and, where advertising cookies are running, a hashed copy of the name, email address and mobile number you enter into a form here. This is the one advertising platform that receives details you typed, and it is set out in full under 'What advertising platforms receive when you submit a form' above
    • LinkedIn, which receives page-view information through its tag on this website, where advertising cookies are running, and none of the details you enter into a form
    • X (formerly Twitter), which receives page-view information through its website tag where advertising cookies are running, and none of the details you enter into a form. It reports into an X advertising account held for Charnwood Systems
  • Website Hosting and File Storage
    • Fly.io, which hosts this website. No form on this website accepts a file upload, so nothing you send us through it is held in Fly.io's object storage service
  • Email and Productivity
    • Microsoft, whose Microsoft 365 service carries and stores the email in which a form submission reaches us, and the service messages we send you

Overseas recipients. The third parties named above are located outside Australia, principally in the United States: Meta Platforms, Inc., Google, LinkedIn, X, Microsoft and Fly.io are all United States companies, and each may also process information in other countries in which it operates. Sharing personal information with any of them is a disclosure to an overseas recipient under Australian Privacy Principle 8. The contractual safeguards described at the start of this section apply to the providers that act on our instructions. They do not apply in the same way to the advertising platforms, for the reason given above, and the disclosure to read closely is the hashed contact details sent to Meta, set out under 'What advertising platforms receive when you submit a form'.

We also may need to share your personal information in the following situations:

  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • Affiliates. We may share your information with our affiliates, in which case we will require those affiliates to honour this Privacy Notice. Affiliates means any subsidiaries, joint venture partners, or other companies that we control or that are under common control with us. Charnwood Industries Pty Ltd has no parent company: it is the company at the top.
  • Business Partners. We may share your information with our business partners to offer you certain products, services, or promotions.

5. Do we use cookies and other tracking technologies?

In Short: We may use cookies and other tracking technologies to collect and store your information.

We may use cookies and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our Services. 6. How long do we keep your information?

In Short: We keep your information for as long as necessary to fulfil the purposes outlined in this Privacy Notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymise such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

In certain circumstances, you may also have the right to object to the processing of your personal information. If you are located in the EEA or UK and you believe we are unlawfully processing your personal information, you also have the right to complain to your Member State data protection authority or UK data protection authority.

Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us by using the contact details provided in the section 'How can you contact us about this notice?' below.

However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

10. Controls for do-not-track features

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ('DNT') feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognising and implementing DNT signals has been finalised. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.
